Notice of Privacy Practices
THIS NOTICE DESCRIBES HOW Regard Recovery WV, LLC MAY USE AND DISCLOSE YOUR SUBSTANCE ABUSE INFORMATION. PLEASE REVIEW CAREFULLY.
Regard Recovery WV, LLC is required by law to maintain the privacy of your protected substance abuse information. This information consists of all records related to your substance abuse, including demographic information, either created by Regard Recovery, LLC or received by Regard Recovery WV, LLC from other Substance Abuse providers.
We are required to provide you with notice of our legal duties and privacy practices with respect to your protected Substance Abuse information. These legal duties and privacy practices are described in this Notice. Recovery WV, LLC will abide by the terms of this notice, or the notice currently in effect at the time of the disclosure of your protected Substance abuse information.
Recovery WV, LLC reserves the right to change the terms of this notice and to make any new provisions effective for all protected health information we maintain. Clients will be provided a copy of any revised notices upon request. An individual may obtain a copy of the current notice from our office.
Use and Disclosure of Medical Information
Recovery WV, LLC may use and disclose your protected Substance Abuse information without your written consent or authorization for certain treatment, payment, and healthcare operations.
Treatment may include:

Providing, coordinating, or managing Substance Abuse and related services by one or more Substance Abuse providers

Consultations between Substance Abuse providers concerning a client

Referrals to other providers for treatment

Referrals to residential treatment
For example, Recovery WV, LLC may determine that you require the services of a specialist. In referring you to another provider Regard Recovery WV, LLC, LLC may share or transfer Substance Abuse information to that provider.
Payment activities may include:

Activities undertaken by Regard Recovery WV, LLC to obtain reimbursement for services provided to you

Determining your eligibility for benefits or health insurance coverage

Managing claims and contacting your insurance company regarding payment

Collection activities to obtain payment for services provided to you

Reviewing Substance Abuse services and discussing with your insurance company the medical necessity of certain services, coverage under your health plan, appropriateness of care or justification of charges

Obtaining pre-certification and pre-authorization of services to be provided to you

For example, Regard Recovery WV, LLC may submit claims to your insurance company on your behalf. This claim identifies you, your diagnosis and the services provided to you.

Substance Abuse operations may include:

Contracting Substance Abuse providers and clients with information about treatment alternatives

Conducting quality assessment and improvement activities

Conducting outcome evaluations and development of clinical guidelines

Protocol development case management or care coordination

Conducting or arranging for clinical review, legal services and auditing functions

We may not disclose your protected Substance Abuse information to family members or friends who may be involved in your treatment or care without your written permission. Substance Abuse information may be released without written permission to a parent, guardian or legal custodian of a child; the guardian of incompetent adult; the healthcare agent designated in an incapacitated patient’s healthcare power of attorney or the personal representative or spouse of a deceased client.

There are additional situations when Regard Recovery WV, LLC is permitted or required to use or disclose your protected Substance Abuse information without your consent or authorization. Examples include the following

As permitted or required by law:

In certain circumstances, we may be required to report individual substance abuse information to legal authorities such as law enforcement officials, court officials or government agencies. For example, we may have to report abuse, neglect, domestic violence or physical injuries.

For public health activities:

We may release substance abuse records, except for treatment records, to certain government agencies or public health authorized by law upon receipt of written request from the agency.

For health oversight activities:

We may disclose substance abuse records, including treatment records, in response to a written request by any federal or state government agency to perform legally authorized functions, such as management audits, financial audits, program monitoring and evaluation and facility or individual licensure or certification.

Judicial and Administrative Proceedings:

Patient substance abuse records, including treatment records, may be disclosed pursuant to a lawful court order. A subpoena signed by a judge is sufficient to permit disclosure of all substance abuse records.

For activities related to death:

We may disclose client substance abuse records, except for treatment records, to a Coroner or Medical Examiner for the purpose of completing a Medical Certificate or investigating a death.
Regard Recovery WV, LLC provides Opioid Use Treatment services through the methodology of Medically Assisted Treatment (MAT). This includes using medications such as Suboxone, Sublocade, Vivitrol, and Zubsolve. The treatment regime will be discussed between the patient and the provider.
